January 5th, 2016If your New York State driver’s license has been suspended or revoked due to a drug or alcohol-related driving violation, the DMV may issue you a conditional license so that you can do the necessary things in your life that require you to be able to drive. However, there are certain requirements that you must meet in order to get and keep a conditional license, including participating in the Impaired Driver Program (IDP). In order to prepare yourself for enrolling in the IDP, you should know what the program requires, what you must do to complete it, and what the penalties are for not finishing.What can I do with a conditional license? The Impaired Driver Program (IDP), previously known as the Drinking Driving Program, is in-depth alcohol and drug education that helps people identify and change and high-risk behaviors in which they engage. The instruction is given in the forms of multimedia presentations, discussions, and workbook exercises. You must also go through a preliminary screening to identify any risk factors that may indicate a substance abuse disorder.
If you are found to be at risk, you will be referred for clinical assessment. If you are referred for evaluation and potential treatment, you must choose a provider who is preapproved by the Office of Alcohol and Substance Abuse Services (OASAS). If you are unhappy with the results of your evaluation you are allowed to ask for a second one, but you must accept the results of the second one if you choose to have it. In the event that you do not complete your required evaluation or treatment, you will be dropped from the Impaired Driver Program and your conditional license will be revoked. You may also be referred by the court or Department of Probation before you enroll in the IDP. If your assessment determines that treatment will be required, you must complete your treatment before the IDP will issue you a completion certificate.
Adam Militello, Esq.The New York State Impaired Driver Program, also known as the IDP, is a “drug rehabilitation program within the Department of Motor Vehicles,” authorized by NYS VTL 1196. (It was formerly called the Drinking Driver Program.)The IDP is a 7-week program. It is held one evening per week, and each session lasts about 1.5 hours, for a total of 16 hours.
It involves classroom instruction, and it can also result in a referral for drug and alcohol treatment (not to last longer than 8 months unless otherwise recommended by the Department of Mental Hygiene or health officials administering the program). We have been seeing clients consistently referred for treatment by the IDP when their alleged BAC was.15 or higher. Until the treatment is completed, the IDP won’t issue a Notice of Completion, meaning that; (1) you cannot regain full driving privileges; and (2) if the sentencing court ordered you to complete the IDP (as opposed to you voluntarily enrolling), it could take 8 months or longer before the court gets a notification that the program was successfully completed. That could mean more “control dates,” where we go back to court to give the judge a status update.When a person convicted of an alcohol-related driving offense signs up for the IDP, they (typically) become eligible for a post-conviction conditional license issued by the DMV (upon payment of a $75.00 fee).
After a person successfully completes the IDP, and after they have paid all their fines, they (typically) become eligible for full driving privileges. So, if you're convicted of driving while intoxicated on January 1, and you are sentenced to a 6-month revocation of your license, there is good reason to believe you can get your full driving privileges back before July 1.However, not everyone is eligible for the relief offered by taking the IDP. You are not eligible to regain full driving privileges if you were driving a taxi, or a livery cab, were an operator of a bus or school bus, if you held a commercial drivers license, if you were operating a truck or tow truck with a GVWR between 18,000 and 26,000 pounds, or if you were under 21 when you violated the law. Those categories of people may not regain their full driving privileges until their full revocation period has run.

The New York Department Of Motor Vehicles operates the Drinking Driver Program, (DDP) which is a mandatory alcohol and drug rehabilitation program that all motorists who are convicted of a, or any other alcohol related charge are required to attend in order to obtain a, or to obtain a conditional privilege if the motorist has an out of state license. The DDP is required in order for the driver to be reinstated to full unrestricted driving privileges after their sentence has been completed.When your license has been suspended or revoked arising out of a DWI conviction, you must report to the Department of Motor Vehicles to enroll in the DDP. In order to enroll, you will have to present proof of identity with your signature. Since you will not have your physical driver’s license at this time (it will have been taken by the sentencing Court), you must provide proof of identity other than a driver’s license. The Department of Motor Vehicles has a list of acceptable proofs of identity on its website, or at the DMV Call center, also found on its website.The DDP is a seven week program which is comprised of a total of 16 hours of coursework. The cost as of June of 2011 is $225.00 with a $75.00 enrollment fee.
